Important Note

English Version

The Macau Musical and Art Exchange Association (MMAEA, “the Association”) is committed to providing safe, fair, professional and educationally meaningful artistic activities. These Terms apply to competitions, performances, festivals, masterclasses, exchange programmes, auditions and related projects for which MMAEA is identified as organiser, co-organiser, regional coordinator, registration administrator or administrative coordinator.

Each event may also have its own regulations, registration notices, fee information, schedules, technical requirements or event-specific terms. Where an event-specific term is more specific on the same matter, that term will apply to the relevant event, subject always to any mandatory law that cannot lawfully be excluded.

1. Scope and Event Information

1. MMAEA will identify the event name, date, venue, organiser/co-organiser/partner organisations and other key arrangements through the relevant official event page, registration page, confirmation notice or other formal communication. Participants should rely on the latest formal information issued for that event.

2. Some international or cross-border projects may involve an independent organiser, overseas venue, orchestra, academy or other partner. MMAEA is responsible for the work it actually undertakes and expressly commits to provide. Matters independently determined or provided by a third party are subject to the relevant third-party rules and applicable law.

3. Where participation requires eligibility review, repertoire approval, quota confirmation, approval by an overseas organiser or another preliminary process, submission of a registration or payment does not necessarily constitute final acceptance. Final participation is subject to formal confirmation.

2. Registration, Minors and Accuracy of Information

1. Registration must be made through a channel officially announced by MMAEA or the relevant event. Participants, parents, guardians, teachers and registering institutions must provide truthful, complete and accurate information and complete any required amendments or supplements within the stated period.

2. For a participant under 18, registration, payment, provision of personal data and related consents should be handled by a parent, guardian or other appropriately authorised adult. The adult submitting the registration confirms that they have appropriate authority to make the relevant arrangements for the minor.

3. Where a teacher, school, music centre or other institution submits a group registration, the submitting party confirms that it has appropriate authority from the participant or the participant's parent/guardian to provide the information required for registration.

4. Any special request, including requests concerning time, session, jury slot, seating, equipment or other individual arrangements, should be raised at registration. MMAEA will assist where reasonably practicable, but a request does not become a condition or guaranteed arrangement unless confirmed in writing.

5. Before submitting a registration, the applicant should be given access to these Terms and the applicable event-specific terms. Completion of the designated acceptance process confirms that the applicant has read and accepted the applicable terms.

3. Fees, Payments and Administrative Arrangements

1. Participants must follow the fees and payment methods stated on the relevant event page, formal notice or payment instructions at the time of registration. A registration fee is the overall participation fee for the relevant programme and is not an itemised charge for each individual arrangement.

2. Events may be priced in MOP, HKD, RMB, EUR, GBP or another currency. Official prices in different currencies may be set independently. Where a bank, card issuer or payment platform performs currency conversion, the exchange rate and related charges are determined by that financial institution.

3. Payments should only be made to accounts, payment links or payment channels formally designated by MMAEA or the relevant event. A payment made to an unauthorised person or account may not be recognised as a valid registration payment.

4. Where a participant requests an administrative change after confirmation, such as a change of name, category, repertoire, session, certificate or delivery information, and an administrative handling fee applies, the fee will be explained before the request is processed in accordance with the event rules or circumstances.

4. Partner Institutions and Group Registration Support

1. To support arts education, cultural exchange and group participation, MMAEA may work with music centres, schools, arts education institutions, arts organisations and other authorised partners to provide event information, group registration support, data organisation, participant communication, administrative coordination or other event-related assistance.

2. Where a partner actually provides such assistance, MMAEA may provide reasonable administrative, promotional or coordination support payments under the relevant collaboration arrangement. The arrangement may take account of the actual workload, completed registrations, scale of participation or another method agreed in advance.

3. These support arrangements do not increase the participant's published registration fee merely because a partner is involved and are entirely separate from eligibility, adjudication, rankings, awards, progression and other artistic assessment.

4. Where applicable law, an employment or agency relationship, or the partner's internal rules require approval or authorisation before a person may receive any support payment, the relevant partner is responsible for ensuring that the required approval has been obtained. MMAEA may request appropriate confirmation or decline any payment arrangement that does not meet its compliance requirements.

5. No teacher, centre, partner or third party may, without MMAEA's written authority, make guarantees or binding commitments on behalf of MMAEA that go beyond the officially published event information, including commitments regarding refunds, results, judging or awards.

5. Withdrawal, Cancellation, Refunds, Rescheduling and Transfer

1. Once a registration has been confirmed, if a participant withdraws for personal reasons after MMAEA or the relevant event has begun allocating places or arranging venues, juries, tutors, orchestras, production, arrangements, administration or other resources, fees paid are generally non-refundable and non-transferable, unless the event-specific terms, written approval by MMAEA or mandatory applicable law provide otherwise.

2. Where an application is subject to eligibility, repertoire, quota or third-party organiser approval and is ultimately not accepted, the related fees will be handled in accordance with the applicable event-specific terms and law.

3. If MMAEA cancels the principal event and cannot provide a reasonable alternative, MMAEA will, having regard to the circumstances, services already provided, non-recoverable third-party costs, event-specific terms and applicable law, provide an appropriate refund, postponement, transfer, credit or other reasonable remedy.

4. Any transfer of a participant name, place or participation entitlement requires prior written approval from MMAEA. An unauthorised private transfer is invalid.

5. Nothing in this section excludes any right that cannot lawfully be excluded under mandatory applicable law.

6. Schedule, Venue, Jury and Programme Adjustments

1. MMAEA may make reasonable changes to non-core arrangements where required by participant numbers, artistic planning, venue requirements, safety, jury conflicts of interest, artist illness, transport or visa issues, orchestra configuration, technical needs, government requirements or other reasonable operational reasons. Such changes may include schedules, running order, jury composition, lesson times, rehearsal order, rooms within a venue or staffing arrangements.

2. Where a change materially affects a principal service purchased by the participant, MMAEA will provide a reasonable response having regard to the circumstances, event-specific terms and applicable law.

3. Participants must check in at the formally announced time and follow reasonable directions from on-site staff. Lateness, absence or failure to complete check-in on time may affect participation, scoring, performance or award arrangements.

4. Venue access, seating, accompanying-person admission and other on-site arrangements are subject to the relevant event notice and venue rules.

7. Adjudication, Results, Awards and Conflicts of Interest

1. Adjudicators should make professional assessments independently in accordance with the artistic criteria adopted or published for the event. Collaboration support arrangements involving a music centre, school, teacher or other partner must not influence adjudication, ranking, awards or progression.

2. Where an adjudicator has a direct conflict of interest that requires management, MMAEA may arrange recusal, replacement, a change of jury composition or another reasonable measure appropriate to the event.

3. Professional judgments concerning musicality, technique, expression, artistic understanding and other artistic matters are, in principle, the final artistic assessment of that adjudication.

4. Where there is a reasonable basis to believe that an objective administrative error occurred, such as a data-entry error, calculation error or participant/category mismatch, an administrative review may be requested within the period specified for the event. If no period is specified, the request should be made within seven days after the official result is published.

5. Awards, certificates, delivery, winner performances and other follow-up arrangements are governed by the relevant event regulations or formal notice. Unless clearly stated before registration as a condition of a specific award or entitlement, participation in a later invited performance is generally voluntary.

8. International Events, Travel, Accommodation and Third-Party Services

1. Unless expressly included in the relevant event information, flights, visas, insurance, hotels, private transport, meals, practice rooms and other personal travel arrangements are the participant's responsibility.

2. Where MMAEA provides information about hotels, transport, flights, restaurants, tourism, practice venues or other third-party services merely as a reference or assistance, this does not amount to an additional guarantee by MMAEA regarding the availability, price or performance of an independent third party.

3. Where an event notice advises participants to wait for final acceptance, schedule or venue confirmation before purchasing non-refundable flights, accommodation or other personal arrangements, participants should follow that advice. Losses arising from personal bookings made before formal confirmation will be addressed according to responsibility and applicable law.

4. Participants are responsible for ensuring that their travel documents, visas, entry eligibility and insurance meet the requirements of the destination.

9. Personal Data and Communications

1. MMAEA processes the personal data of applicants, participants and their parents/guardians in accordance with applicable law and MMAEA's Privacy and Personal Data Policy. Data may be used, to the extent necessary, for registration, payment verification, eligibility review, scheduling, adjudication administration, certificates and awards, event production, safety management and related event coordination.

2. Where an event involves an overseas organiser, venue, orchestra, academy, adjudicator, tutor, technical provider, certificate/award producer, accommodation provider or transport partner, necessary data may be shared with the relevant party to the extent lawful and necessary.

3. Where a participant submits medical certificates, allergy information, injury information or other health data, MMAEA will process such information only where genuinely necessary and legally permitted, with an appropriately higher level of protection.

4. Requests to access, correct, erase, object to or otherwise exercise data-protection rights will be handled in accordance with applicable law and MMAEA's lawful retention obligations. Certain records may need to be retained for accounting, legal, insurance, dispute-resolution or other legitimate reasons.

5. Administrative communications necessary for registration and event delivery, including payment, schedule, results, safety, event changes and travel information, are service communications. Marketing for future unrelated activities should be based on a separate and optional choice, and recipients may opt out in accordance with applicable rules.

10. Photography, Recording, Media and Intellectual Property

1. Participants acknowledge that photography, audio recording and video recording may take place during competitions, performances, award presentations, classes and other event activities. To the extent permitted by applicable law and where any required consent or authorisation has been obtained, MMAEA and authorised production or media partners may reasonably use a participant's name, image, voice and event performance excerpts for event records, news, education, archives and promotion of MMAEA or the relevant event.

2. This arrangement does not automatically transfer to MMAEA the copyright in a participant's pre-existing work or in third-party musical works. MMAEA retains the rights it lawfully holds in photographs, videos, designs, text and other materials that it creates or is authorised to use.

3. When submitting or using accompaniment tracks, scores, arrangements, audio, video, images or other materials, the participant must ensure that they have the rights or permissions required for the intended event use. Where there is a reasonable concern, MMAEA may request replacement material or appropriate evidence of authorisation.

4. Unless an event provides otherwise, accompanying persons may photograph or record the participant they are supporting. They must not persistently or closely record other participants without appropriate consent or interfere with the event, adjudication or other persons.

11. Instruments, Equipment and Technical Arrangements

1. MMAEA provides only the instruments, equipment or technical support expressly stated in the event regulations or formal notice. Other personal instruments, accessories, music stands, pedals, cables, accompaniment devices and specialised equipment are the participant's responsibility.

2. Participants are responsible for confirming in advance that their own instruments and equipment are suitable and for allowing reasonable time for transport, installation, tuning and testing.

3. If core equipment supplied by MMAEA or the venue experiences a material technical failure not caused by the participant, MMAEA may, having regard to fairness, practicability and the event flow, arrange a restart, delay, re-performance or another reasonable remedy.

4. Child auxiliary pedals, drum kits, special percussion instruments, testing windows and other technical details are governed by the relevant event-specific technical rules or on-site announcements.

12. Conduct, Safety and On-Site Order

1. Participants, parents, teachers, accompanying persons and visitors must comply with venue rules, safety requirements and reasonable directions from event staff.

2. Where a person seriously disrupts the event, interferes with another performance or adjudication, threatens safety, harasses staff or participants, damages the venue, or refuses to comply with a reasonable safety requirement, MMAEA may require the conduct to stop or require the person to leave. Where the conduct is serious and directly affects fairness or safety, the related participation may be disqualified.

3. Participants are responsible for the reasonable safekeeping of cash, electronic devices, instruments and other personal belongings.

13. Force Majeure and Events Beyond MMAEA's Reasonable Control

1. Where an event cannot proceed as planned because of extreme weather, natural disaster, public-health events, government measures, war, terrorism, industrial action, major transport disruption, border or visa restrictions, sudden venue unavailability, major technical incidents or another event beyond MMAEA's reasonable control, MMAEA may postpone, relocate, change timings, modify part of the delivery format, transfer participation to another session or adopt another reasonable alternative.

2. Where such a change materially affects a principal service purchased by the participant, MMAEA will provide a reasonable follow-up response having regard to the nature of the event, services already provided, non-recoverable third-party costs, event-specific terms and applicable law.

14. Scope of Responsibility

1. To the extent permitted by applicable law, MMAEA is not responsible beyond what the law requires for loss caused by the participant's own conduct, an independent third party, failure to follow formal instructions, or circumstances outside MMAEA's reasonable control.

2. MMAEA will manage the work it actually undertakes to a reasonable standard. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for personal injury, health, intentional misconduct or gross negligence where such liability cannot be excluded by law.

3. Where a participant requires a special arrangement because of health, physical condition or another relevant circumstance, the participant should notify MMAEA within a reasonable time. MMAEA will consider reasonable arrangements in light of the nature of the event, venue conditions and practical feasibility.

15. Enquiries, Complaints and Administrative Review

1. Enquiries or complaints relating to registration, payment, data, scheduling, event administration or another non-artistic matter should be submitted through MMAEA's officially published contact channel and should include the participant's name, event name, relevant date, facts and supporting information sufficient for verification.

2. Where the matter concerns on-site safety, availability, incorrect information or another time-sensitive issue, it should be raised as soon as reasonably practicable so that MMAEA has an opportunity to address it.

3. MMAEA will review and respond through a reasonable process. Artistic adjudication is not ordinarily re-marked, but objective administrative or calculation errors may be reviewed in accordance with these Terms and the relevant event rules.

16. Updates, Language, Governing Law and General Provisions

1. MMAEA may update these Terms where reasonably required by law, regulation, safety, technology, event operations or other legitimate needs. For a confirmed registration, the version provided to and accepted by the applicant at the time of registration will generally apply. If a material update is required for legal or significant practical reasons, affected persons will be notified by a reasonable method.

2. These Terms may be available in Chinese, English and other languages. In the event of inconsistency between language versions, the Traditional Chinese version will be the primary text for interpretation to the extent permitted by law, unless mandatory applicable law provides otherwise.

3. Unless the applicable event-specific terms or mandatory law provide otherwise, these Terms and the relevant contractual relationship with MMAEA are governed by the laws of the Macao Special Administrative Region. The parties should first attempt to resolve a dispute through MMAEA's formal complaint and good-faith discussion process. To the extent permitted by law, the courts of the Macao Special Administrative Region have non-exclusive jurisdiction.

4. If any part of these Terms is found invalid, unenforceable or inapplicable, that part will be adjusted only to the minimum extent necessary or will not apply, and the remaining Terms will continue in effect.

5. Nothing in these Terms excludes, limits or removes any right, remedy or liability that cannot lawfully be excluded or limited under the mandatory law of an applicable jurisdiction.
